DIGITAL ESCAPE — TERMS & PRIVACY

POLICY

Effective Date: 29 January 2026

This document governs the use of Digital Escape Africa (DEA), including but not limited to:

  • Escape Marketplace
  • Escape Hub
  • EscapeMag
  • Blogs & Editorial Content
  • Videos & Feeds
  • Vendor & Manufacturer dashboards (where applicable)

By accessing or using any part of the Digital Escape platform, you agree to these Terms & Policies.

1. PLATFORM OVERVIEW & DATA USE

Digital Escape Africa is a creative ecosystem that combines media, commerce, and community. Users on the platform may be:

  • General users / buyers
  • Creative vendors
  • Manufacturers / production partners

Each role has different access and responsibilities, but all users are bound by these core terms.

2. PRIVACY POLICY

Data Collection

  • We collect personal identifiers, including your full name, email address, telephone number, and physical shipping/billing addresses.
  • Account credentials such as usernames and passwords are collected to manage your access.
  • Payment information is processed securely through authorized third-party providers; Digital Escape Africa does not store full credit card or bank card details on its servers.
  • We collect content submissions, including any articles, photos, videos, or product listings you upload to the platform.
  • Technical usage data, such as IP addresses, device types, visited pages, and time spent on the platform, is automatically recorded

How Information is Used

  • Your data is used to fulfill marketplace orders and facilitate secure payment processing.
  • We use collected information to publish and manage content across our magazine, blog, and marketplace ecosystems.
  • With your explicit consent, we may use your contact details to send platform updates, newsletters, and promotional offers.
  • Data is utilized to monitor and improve site security, performance, and user experience.
  • We process information as necessary to comply with our legal and regulatory obligations.

Third-Party Sharing

  • We share your information with essential service providers, including payment processors, web hosting services, and logistics/shipping partners.
  • Information may be shared with brand partners for co-branded events or marketing campaigns, but only where you have provided prior consent.
  • Data may be disclosed to legal authorities when required by law or to protect the rights and safety of our community.
  • Digital Escape Africa strictly prohibits the sale of your personal data to any third parties.

Cookies

  • We utilize cookies to maintain site functionality and enable a personalized user experience.
  • Cookies are also used for analytical purposes to help us understand how users interact with our platform.

Data Retention & Rights

  • We retain your data for as long as necessary to provide our services and comply with legal requirements.
  • You have the right to access, rectify, or request the deletion of your personal data at any time.
  • Users may restrict the processing of their data or opt out of marketing communications by contacting our support team.

ACCOUNT & ACCESS

  • Age Requirement: You must be 18 years or older to create an account.
  • Security: You are responsible for maintaining the security of your account.
  • Termination: DEA reserves the right, at its sole discretion, to refuse service, suspend, restrict, or terminate any account with or without prior notice, where necessary to protect the platform, users, or comply with legal obligations.

Note: General users (buyers/readers) do not have dashboards or wallets. Vendors and manufacturers do have dashboards with additional features.

3. ACCEPTABLE USE & CONTENT RULES (APPLIES TO ALL USERS)

These rules apply to everyone on the platform — users, vendors, manufacturers, and contributors.

You may NOT upload, post, or share:

  • False, misleading, or fraudulent content
  • Stolen, plagiarized, or unlicensed material
  • Hate speech, harassment, or discriminatory content
  • Explicit, violent, or illegal material
  • Spam, scams, or deceptive promotions

This applies to:

  • Posts on Escape Hub
  • Blogs & editorial submissions
  • Videos and comments
  • Product descriptions & images
  • Messages and interactions

Enforcement: DEA reserves the right to edit, remove, or restrict content, and to suspend or terminate accounts for violations.

4. BUYERS & USERS (NON-SELLERS)

4.1 Shopping on the Marketplace

  • Buyers can browse, follow creators, and purchase products.
  • DEA acts as a platform connecting buyers and vendors; DEA is not the direct seller unless explicitly stated.

4.2 Returns & Refund Policy (BUYERS)

All sales are final unless a valid issue is proven.

Buyers are eligible for a store credit coupon or a cash refund if they can provide clear evidence of:

  1. Damaged item on arrival
  2. Wrong item delivered
  3. Manufacturing defect

Important Conditions:

  • Proof must be submitted within 48 hours of delivery.
  • Proof must include photos or videos.

Approved Returns Result In:

  • A coupon credit issued to the buyer's account.
  • Coupons can only be used on the Digital Escape Marketplace.

DEA's decision on return eligibility is final and binding. DEA reserves the right to reject claims that do not meet these requirements.

5. VENDORS & MANUFACTURERS — PAYOUT & EARNINGS POLICY

⚠️ This section applies ONLY to vendors and manufacturers. General users/buyers do not earn, withdraw, or access wallets.

5.1 Earnings Visibility

  • Earnings reflect instantly in the vendor or manufacturer dashboard.
  • Wallet balances update as soon as a transaction is completed or an order is marked delivered.

5.2 Withdrawals

  • Vendors and manufacturers may withdraw at any time using the Withdraw button in their dashboard.
  • There are no fixed payout cycles or waiting periods.

5.3 Delays

DEA does not guarantee uninterrupted access to dashboards, wallets, or withdrawal features and shall not be liable for temporary system delays, banking failures, or third-party payment processor issues.

In rare cases where withdrawals are delayed:

  • Users may manually initiate withdrawal via the dashboard.
  • DEA support will resolve issues promptly.

5.4 Responsibility

Vendors and manufacturers are responsible for:

  • Ensuring correct bank details.
  • Monitoring their dashboard balances.
  • Complying with all fulfilment and quality rules.

6. VENDOR & MANUFACTURER RESPONSIBILITIES (SUMMARY)

  • Vendors are responsible for product accuracy, fulfilment, and customer satisfaction.
  • Manufacturers are responsible for production quality, timelines, and dispatch readiness.
  • Both parties must follow their separate Marketplace Policy documents, which are publicly available.

7. INTELLECTUAL PROPERTY

  • All DEA branding, logos, original content, and platform assets belong to Digital Escape Africa.
  • Users retain ownership of their content but grant DEA a non-exclusive, royalty-free license to display and distribute it.
  • Unauthorized reproduction of DEA materials is prohibited.
  • DEA reserves the right to remove or disable access to content alleged to infringe intellectual property rights, without prior notice, and without liability.

8. DISCLAIMERS & LIMITATION OF LIABILITY

  • DEA does not guarantee uninterrupted service.
  • Products are sold "as is" by vendors unless otherwise stated.
  • DEA is not liable for indirect losses, delays, or damages beyond platform control.
  • To the maximum extent permitted by law, Digital Escape Africa shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from platform use.

9. TERMINATION

DEA reserves the right to suspend or terminate any account, remove content, or restrict access if these terms are violated or if actions harm the community or platform. Termination decisions are at DEA's sole discretion and may occur without obligation to provide reasons.

10. GOVERNING LAW

These Terms & Policies are governed by the laws of the Federal Republic of Nigeria.

11. CHANGES TO THIS POLICY

DEA may update these Terms from time to time. Updates will be published with a revised effective date.
